Is it legal for a business to not accept cash in New York state?

It is lawful for a business in New York State to decline a cash payment, but with certain limitations depending on the locality and nature of the business. Indeed, in New York City, starting from November 2019, businesses must generally accept cash under a new law enacted to promote inclusionary payments and bar discrimination against those unable to engage in digital modes of paying for purchases. This law applies to virtually all retail and food establishments, giving equal opportunity to access goods and services.

However, some are exempted. Any business that operates on a membership basis, online sales, or even seasonal and other temporary businesses are not bound by this rule. In addition, purchases that involve security deposits, rentals, or high-value items are usually allowed to have specified payment methods for convenience and security reasons.

Except for New York City, there is no statewide law which compels businesses to take cash. This legal looseness allows businesses outside the city to implement cashless payment policies. At the same time, it's fair to say that a "no cash" policy will bring customer dissatisfaction and bad press since cash is widely used for all kinds of consumers.

Cashless businesses always take the step for efficiency, security, and convenience. Digital payment channels may streamline transactions and minimize theft risks, in addition to reducing administrative costs from cash handling. At the same time, they need to weigh these against customer exclusion, particularly in areas with continued cash usage.

In summary, while businesses in New York City must generally accept cash, companies in other parts of New York State can legally choose to operate cash-free. Entrepreneurs should stay updated on changing regulations and evaluate customer preferences before implementing such policies.
